TERMS AND CONDITIONS

Last updated: 2 September 2026

OVERVIEW

This website, northernrest.ca (the "Website"), is operated by Sanovex OÜ, an Estonian company trading as NorthernRest. Throughout these Terms, "we", "us" and "our" refer to Sanovex OÜ.

These Terms and Conditions (the "Terms") govern your use of the Website and any purchase you make from it. By visiting the Website or placing an order, you agree to be bound by these Terms and by the policies they refer to: our Privacy Policy, Cookie Policy, Shipping Policy and Returns and Refunds Policy.

Please read these Terms before placing an order. If you do not agree with them, please do not use the Website.

The Terms that apply to your order are the Terms in force at the time you place it. If we later change these Terms, the change applies to future orders only and does not affect an order you have already placed. Section 19 explains how we make changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform through which we sell to you.

SECTION 1 — WHO MAY USE THE WEBSITE

The Website is intended for adults. By placing an order, you confirm that you are of the age of majority in your province or territory of residence.

You may not use our products for any unlawful purpose, and you may not violate any law of your jurisdiction in using the Website.

You must not transmit any worm, virus or other code of a destructive nature.

SECTION 2 — GENERAL CONDITIONS

You understand that content you send us, other than payment details, may be transmitted unencrypted across networks and may be adapted to the technical requirements of connecting networks or devices. Payment card information is always encrypted in transit.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Website or its content without our written permission.

Headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 3 — INFORMATION ON THE WEBSITE

We take care to keep the information on the Website accurate and up to date. General information we publish — articles, guidance, comparisons and similar content — is provided for information only and is not a substitute for professional advice.

Our products are comfort and support aids intended for everyday use. If you have a medical condition, or if pain persists or worsens, consult a healthcare professional before use.

SECTION 4 — PRICES

All prices are shown in Canadian dollars (CAD).

Prices may change over time. The price that applies to your order is the price displayed on the Website at the time you place it. We will never charge you more than the total shown to you at checkout. Section 5c sets out what that total includes.

SECTION 5 — PRODUCTS

Certain products may be available exclusively online and in limited quantities.

We make every effort to display the colours and images of our products as accurately as possible. Colours may vary slightly depending on your screen.

We may limit the sale of our products to any person or geographic region, and we may limit the quantity of any product, on a case-by-case basis. We may discontinue a product at any time. Any offer made on the Website is void where prohibited.

SECTION 5a — WARRANTIES

Legal warranty. Every product you buy from us is covered by a legal warranty that applies automatically, free of charge, and independently of any warranty we offer. Under the Consumer Protection Act of Quebec, goods must be fit for the purpose for which goods of that kind are ordinarily used (section 37), must be durable in normal use for a reasonable length of time having regard to their price, the terms of the contract and the conditions of use (section 38), and must be free of latent defects (section 53). The other provinces and territories provide comparable legal warranties. These rights apply regardless of how often you have used the product, and they cover defects that only become apparent after a period of normal use.

Our commercial warranty. In addition to the legal warranty, we warrant our products against manufacturing defects. This commercial warranty does not cover damage caused by normal wear and tear, misuse, improper application or accidents. It is in addition to your legal warranty and never replaces or reduces it.

Making a claim. Contact us at info@northernrest.ca with your order number and a description of the defect. We will offer you a repair, a replacement or a refund. Where the product is defective, we bear the cost of returning it to us.

SECTION 5b — ORDER CANCELLATION AND RETURNS

You may cancel your order at no charge within 24 hours of placing it, provided it has not yet shipped, by emailing info@northernrest.ca with your order number. No return is required in that case and we refund you in full.

After shipment, you may return any item within 30 days of receipt, in its original unused condition, in accordance with our Returns and Refunds Policy.

These are commercial policies we offer in addition to your legal rights. They do not limit any cancellation right granted to you by the consumer protection law of your province or territory — including, in Quebec, your right to cancel where the information required before a distance contract is concluded was not disclosed to you, or where the goods are not delivered within 30 days of the date we indicated.

Unless the item is faulty, defective or incorrect, or unless you are exercising a cancellation right granted to you by law, return shipping costs are your responsibility. Where you exercise a statutory cancellation right, we bear the cost of returning the goods.

Where you cancel, we refund you within 15 days, and within any shorter period required by the law of your province or territory.

SECTION 5c — WHAT YOUR TOTAL INCLUDES

The total shown to you at checkout is the full amount you pay. It includes the price of the items in your basket in Canadian dollars, any sales taxes that apply, delivery — which is free for all orders within Canada — and any customs duties or import charges on your order.

You will not be asked to pay any further amount on delivery. If a carrier ever asks you for a customs, duty or import charge on an order placed with us, do not pay it and contact us at info@northernrest.ca; if you have already paid it, we will reimburse you.

Before you confirm your order, the Website shows you the description and quantity of the goods, the itemised price, any applicable taxes, the total payable, the currency, the delivery method and estimated delivery time, and our cancellation and return policy.

SECTION 6 — ORDERS, BILLING AND ACCOUNT INFORMATION

We may refuse or cancel an order where the product is unavailable, where there has been an obvious error in the price or description, where we have reasonable grounds to suspect fraud, or where the order appears to be placed by a dealer, reseller or distributor. If we cancel an order you have already paid for, we refund you in full within 15 days.

We may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same account, the same payment card, or the same billing or shipping address.

If we change or cancel an order, we will try to contact you using the email address, billing address or phone number you provided when placing it.

You agree to provide accurate and complete purchase and account information, and to keep it up to date so that we can complete your transaction and contact you when needed.

SECTION 7 — OPTIONAL TOOLS

We may give you access to third-party tools that we neither monitor nor control.

You acknowledge that we provide access to such tools "as is" and "as available", without warranties or endorsement, and that your use of them is at your own discretion. You should make sure you are familiar with the terms on which the relevant third party provides them.

We may offer new services or features through the Website in future. Those will also be subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

Content, products and services available through the Website may include material from third parties, and links on the Website may direct you to third-party websites that are not affiliated with us.

We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites, and we are not liable for transactions you make with third parties. Please review their policies before engaging with them, and direct any complaint about a third party's products to that third party.

SECTION 9 — USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you send us creative ideas, suggestions, proposals, plans or other materials, whether at our request or on your own initiative (collectively, "comments"), you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium. We are under no obligation to keep comments confidential, to pay compensation for them, or to respond to them.

We will not publish your name, contact details or any other personal information alongside your comments without your consent.

We may, but are not obliged to, monitor, edit or remove content we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes a third party's rights or these Terms.

You agree that your comments will not infringe any right of any third party, will not be defamatory, abusive, obscene or otherwise unlawful, and will not contain any virus or malware. You may not use a false email address or misrepresent the origin of your comments. You are solely responsible for your comments and their accuracy.

SECTION 10 — PERSONAL INFORMATION

The personal information you submit through the Website is handled in accordance with our Privacy Policy, which explains what we collect, why, who we share it with, how long we keep it, and what rights you have.

SECTION 11 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally information on the Website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, transit times or availability. We may correct such errors and update the information at any time.

Where an obvious error affects an order you have already placed — for example a price that is manifestly wrong — we will contact you before doing anything, and you may either confirm the order at the corrected price or cancel it for a full refund. We will not cancel a correctly priced order that we have accepted.

SECTION 12 — PROHIBITED USES

In addition to the prohibitions elsewhere in these Terms, you may not use the Website or its content: (a) for any unlawful purpose; (b) to solicit others to perform or take part in unlawful acts; (c) to violate any international, federal, provincial, territorial or local law, regulation or ordinance; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene purpose; or (k) to interfere with or circumvent the security features of the Website. We may terminate your use of the Website for any of these.

SECTION 13 — LIMITATION OF LIABILITY

Rights that cannot be limited. Nothing in these Terms limits or excludes:

  • any legal warranty, condition or right that applies to you under the consumer protection legislation of your province or territory and that cannot be excluded by contract — in Quebec, this includes the legal warranties under sections 37, 38 and 53 of the Consumer Protection Act, described in section 5a above;
  • our liability for bodily or moral injury caused to you, which cannot be excluded or limited in any way (article 1474 of the Civil Code of Québec);
  • our liability for fraud or fraudulent misrepresentation;
  • any other liability that cannot lawfully be excluded or limited.

Where any provision of this section conflicts with such a right, that right prevails and the provision does not apply to you.

The Website. We do not warrant that your use of the Website will be uninterrupted, timely, secure or error-free, or that the results obtained from using it will be accurate or reliable. We may suspend or withdraw the Website temporarily, and we will give notice where we reasonably can.

Other losses. Subject to the paragraphs above, we are not liable for indirect or consequential loss — including lost profits, lost revenue, lost savings, loss of data or replacement costs — arising from your use of the Website. Our total liability in connection with an order is limited to the amount you paid for that order, except where the law does not permit such a limit.

Some provinces and territories do not allow the exclusion or limitation of liability for consequential or incidental damages. In those provinces and territories, our liability is limited only to the extent the law permits.

SECTION 14 — INDEMNIFICATION

You agree to indemnify and hold harmless Sanovex OÜ and its officers, directors, employees, agents and service providers from any third-party claim arising out of your breach of these Terms, your violation of any law, or your infringement of the rights of a third party. This does not apply to any claim arising from our own act or omission.

SECTION 15 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforceable to the fullest extent permitted by applicable law, and the unenforceable part will be severed. This does not affect the validity of the remaining provisions.

SECTION 16 — TERMINATION

Obligations and liabilities incurred before termination survive the termination of this agreement.

These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by ceasing to use the Website.

If you fail to comply with these Terms, we may terminate this agreement and deny you access to the Website. You remain liable for amounts due up to the date of termination, and termination does not affect any order already placed or any right you have in respect of it.

SECTION 17 — ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies we publish on the Website, constitute the entire agreement between you and us in respect of your use of the Website, superseding any prior agreements or communications between you and us.

SECTION 18 — GOVERNING LAW AND JURISDICTION

These Terms are governed by Estonian law.

This choice of law does not deprive you of the protection of the mandatory rules of the law of your province or territory of residence. For consumers residing in Canada, the mandatory consumer protection provisions of applicable federal, provincial and territorial law also apply, including the Consumer Protection Act of your province or territory and the Competition Act.

If you reside in Quebec, you may bring proceedings before the courts of Quebec, and any stipulation to the contrary cannot be set up against you (article 3149 of the Civil Code of Québec). Nothing in these Terms requires you to waive your right to bring or take part in a class action, or obliges you to submit a dispute to arbitration.

SECTION 19 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our products, our operations or the law. The current version is always available on this page, together with the date it was last updated.

A change to these Terms does not apply to an order you have already placed. That order continues to be governed by the Terms that were in force when you placed it.

Where you have an ongoing contract with us and we amend one of its terms, we will send you a written notice at least 30 days before the amendment takes effect. The notice will be drawn up clearly and legibly, will set out the new or amended clause and the former one, will state the date on which the amendment comes into force, and will inform you of your right to refuse the amendment and to rescind the contract at no cost by notifying us before that date. This reflects section 11.2 of the Consumer Protection Act of Quebec, and we apply it to all our customers.

SECTION 19a — COMPLAINTS AND CONSUMER PROTECTION AUTHORITIES

If something has gone wrong, please contact us first at info@northernrest.ca. We will look into it and reply to you.

If we are unable to resolve your complaint, you may contact the consumer protection authority of your province or territory:

At the federal level, you may also contact the Office of Consumer Affairs: ised-isde.canada.ca. An up-to-date list of all federal, provincial and territorial consumer affairs offices is maintained at ised-isde.canada.ca.

For complaints about how we handle your personal information, please see section 8 of our Privacy Policy.
